Terms and Conditions

   

Introduction


This document has been created for the benefit of all our customers. Its intention is to...

  1. Maximise reliability, availability, and stability of the network and its resources for all users.
  2. Minimise time and resources wasted on abusive users.
  3. Minimise harm and distress caused by abusive users.

Breaking the terms of this policy could lead to any or all of the following actions...

  1. Cancellation of services and accounts without notice.
  2. Criminal or civil proceedings.
  3. Little or no refund of monies paid for cancelled services.
  4. A bill for legal fees, administrative fees and other costs incurred.

Please ensure that your contact details are correct at all times in case we need to contact you about your site / services etc.

Please note that abuse or misuse of the services provided will not be tolerated and sites can and will be shut down without notice.


Disclaimers


Computers, networks and services have problems and failures from time to time. Data can and does go missing. Networks do go down occasionally. And, nothing is ever completely secure. A lot of time and money has been spent to minimise the risks with backups, spares, monitoring, patches and special protocols - but the risk will never go away, it can only be reduced. Therefore...

  1. The services are provided ‘as is’ with no warranties and with no guarantees of any kind.
  2. We will not be held liable for; loss of service, disconnection, loss of data, hardware failure, power failure, disclosure of data or financial loss, or other loss incurred because of any of the them.
  3. Customers must take precautions to minimise any loss that might occur.
  4. Financial obligations to the customer will never exceed the amount the customer has paid during the previous six months.

Data Protection and Privacy


Your personal data will not be passed on to anyone outside of our organisation (nor will they be granted access) unless...

  1. You have given us permission.
  2. We are required by law.
  3. You are in debt to us.

Please note that your contact details are required for some internet services. If you require those services, your contact details will be needed by the third party. Some third parties have publicly available records and your contact details will then be available to anyone that requests them. Contact details are often required for domain names, security certificates and allocation of IP numbers.

Data crossing our network is switched to help maximise the privacy of that data. But, the same standards do not apply to the rest of the internet. Therefore, confidential information should not be transmitted across the internet unless it is encrypted. Use of software such as Putty or WinSCP are recommended as are protocols such as HTTPS and SSH. These should be used in preference to HTTP, Telnet or FTP. When sending confidential information by email or FTP, encryption should be used.

We backup lots of information for the safety and security of everyone. However...

  1. Users should maintain and manage their own backup system
  2. We will not be responsible for backing up your data.
  3. If you request access to backups of your data then we may charge you.
  4. If your account is terminated or closed, your data may be deleted.

Acceptable Use Policy


You are not permitted to store, copy, sell, promote or distribute any of the following...

  1. Viruses, trojans, malware, adware, spyware, or keyloggers.
  2. Hacking, cracking, scanning and probing tools.
  3. Software or lists for spamming or UCE.
  4. Materials or information that is libelous, slanderous, racist or defamatory.
  5. Inaccurate, false, fraudulent or misleading information.
  6. Copyright material without consent.
  7. Materials or information to incite violence, cruelty or racial hatred.
  8. chainletters, pyramid schemes, multi-level-marketing schemes.
  9. 'adult' content or material.
  10. Illegal materials, content or information.
  11. Software or information which compromises security or privacy.

Prohibited activities...

  1. Promoting, facilitating or engaging in activities contrary to UK law.
  2. Promoting a website, email address, service or other point of contact with mass text messaging, auto-diallers, random-diallers, cold -calling, uce, spam, adware, spyware, viruses, viral marketing, and all other forms of multiple personal contact.
  3. Deleting, changing or viewing files or information outside of your home directory.
  4. Tampering with log files.
  5. Compromising security.
  6. Sniffing, IP-spoofing, or MAC-spoofing.
  7. Using IP-addresses or MAC addresses which you have not been allocated.
  8. Phishing, Pharming.
  9. DOS-ing, DDOS-ing, attacking or flooding networks.
  10. Sending forged, spoofed, illegal or malformed packets.
  11. Network abuse.
  12. Posting files or information which may cause harm or offence to others.

Users must...

  1. Act with honour and consideration for others at all times.
  2. Be considerate of the security, safety, and privacy of other users.
  3. Keep passwords and usernames safe and secret.
  4. Maintain accurate, valid, correct, complete and up-to-date contact details.
  5. Tag Pages or sites unsuitable for children appropriately.

Users must not...

  1. Hog resources. (Non dedicated hardware is shared. So users must not expect to use large amounts of CPU time, hard drive space, network bandwidth or other resources.)
  2. Abuse the equipment, tamper with it or interfere with it.
  3. Affect the safety or reliability of our network or services.
  4. cause others to complain about their behaviour.
  5. Affect the profitability or viability of our business.

Domain Names


By registering a .uk domain name, you enter into a contract of registration with Nominet UK on the following terms and conditions (link). This is a separate contract to any arrangement you may have with us for the provision of internet services. Please read before proceeding with your order.

Likewise, similar agreements exist for .com and other associated domains (link).


Changes


This terms will change from time to time.
